I tried to WARN you folks of the many problems I was experiencing due to the actions and/or inactions of my home builder; “C.P. MORGAN”, in early February, 2006.  My response from Bank Of America was “We Don’t Care” !!!

 

Well, at the time of this writing – “I DON’T CARE”!!!

 

My Bank, (Bank Of America), My Insurance Company, (State Farm), The Builder of my home, (C.P. Morgan), and the Johnson County Health Department – have done

next to NOTHING to help me.  (FOR COMLETE DETAILS SEE WEBSITE:  cpmorgancomplaints.com (This is my website explaining the deplorable treatment I have received from C.P. Morgan, the builder of my home from January 27 through March 31).

 

My home “closed” on November 1, 2004, (brand new home).  My home has had nothing but problems due to the poor quality of workmanship done by C.P. Morgan and/or its’ subcontractors, SINCE November 1, 2004.

 

As of Today’s Date (October 4, 2006):

 

       My Home needs to be completely repainted (AS OF YET NOT SHOWROOM MODEL FINISH)

 

       Many of the “Hardy Plank Siding” still need to be replaced on the exterior of the home (AS OF YET NOT SHOWROOM MODEL FINISH)

 

       The furnace and air conditioner are ABSOLUTELY too small for this big of a house, (3250 square feet – full basement – 9 foot ceilings in the basement, 1st floor and 2nd floor.  The heater has to “run” for approximately 59 minutes of every hour – same can be said for the Air Conditioner.  Just a note:  The Air Conditioner Unit (outside) is not even Mounted on a base – it is just sitting there for anyone big enough to walk away with it.

The furnace has three “Holes” in it:

              1). Approximately 8 inches in diameter

              2). Approximately 5 inches in diameter

              3). Approximately 4 inches in diameter

(None of C.P. Morgan Models have furnaces with the aforementioned holes – NOT SHOWROOM MODEL FINISH).

 

       The water heater has numerous “welded splices” of copper between the water heater and the water sources.  (NOT SHOWROOM MODEL FINISH)

 

       The Kitchen ceiling and 1st Floor Hallway Ceiling and walls need to be repainted – the paint roller marks are still bleeding through (FOR THE 3rd TIME) !!! (NOT SHOWROOM MODEL FINISH)

 

       Believe it or not – to this day – C.P. Morgan, has not even fixed my FRONT DOOR handle and LOCK, (it has been loose since moving into the home on November 1, 2004).  (NOT SHOWROOM MODEL FINISH)

 

       I bought a VERY EXPENSIVE sliding door from C.P. Morgan – I was told I could remove both sliding doors to allow greater access to the home, (while moving in) – this is not the truth – the door only opens approximately 2 ½ feet – the other glass door is mounted permanently.

 

       When I picked out my lot in C.P. Morgan’s Heritage Community I was originally told I could not have Lot 24 or Lot 25 (the two biggest lots in the “Community).  I

then tried for Lot 31 – and after doing all the paper work, a few weeks later I got a call out in Los Angeles California (I intended to move from LA to Indiana).  After flying back to Indiana C.P. Morgan was “Sorry” but their plot people said a house as big as mine would not fit on LOT 31, but I was then told they (C.P. Morgan) would release a much “Bigger Lot” I assumed Lot 24 and/or 25 but C.P. Morgan said those lots would be the LAST lots sold in the Community (at least 3 years wait) – I offered a deposit on Lot 24 and said I would wait but C.P. Morgan said they would not accept my deposit and then told me they would however “release” a much bigger lot – specifically – LOT 23.  I agreed to LOT 23. (JUST A NOTE LOT 24 AND 25 WERE RECENTLY SOLD – I understand there are approximately 350 MORE HOMES to be SOLD in the C.P. MORGAN HERITAGE COMMUNITY) – Once again C.P. Morgan has “misstated the facts” - so much for LOTS 24, and 25 being LAST TO SELL. 

 

       The 1st Floor Hallway (Walls and Floor) has the very high possibility of MOLD and/or RAW SEWAGE ARE STILL WITHIN THESE AREAS.  At this point, unless checked by “Indoor Air Management”,  If there is actually MOLD and/or RAW SEWAGE/FECCAL MATTER, it will most probably spread and eventually cause damage to the structure (HOME) or even WORSE – could create a EXTREME HEALTH HAZARD to the OCCUPANTS OF THIS HOME – ME !!!  It should be NOTED:  C.P. Morgan and/or its’ subcontractors DID – IN MY OPINION – PURPOSLY covered the 1st Floor Hallway floors and

walls (drywall, paint, luan, and vinyl) – because this particular area had FAILED on a previous test – and C.P. Morgan did not want the home to fail again.  Indoor Air Management could not take tape and swab samples THROUGH the drywall of the 1st Floor Hallway nor any samples were accessed THROUGH THE LUAN AND VINYL on the floor of this Hallway.  Indoor Air Management “Cleared the home – with HESITATION” – (As I understand it – the AIR QUILITY - AT THE TIME OF THE TEST was considered SAFE – however – WITHOUT access to the 1st Floor Hallway walls and floor, Indoor Air Management was unable to OFFICIALLY make a determination if the MOLD and/or RAW SEWAGE/FECAL MATTER was remediated properly).  

 

Another note:  If MOLD and/or RAW SEWAGE/FECCAL MATTER is behind one of the 1st Floor Hallway walls or in the floorboards of this hallway – it is EXTREMELY possible with time, the MOLD and/or BACTERIA could reproduce at such a rate, that the ONCE – SAFE AIR QUALITY, IN MY HOME – would then be UNSAFE FOR HUMAN OCCUPANCY OF THIS RESIDENCE.

  

       Since the BASEMENT was poured – there have been three rather large cracks.  These cracks are still there and according to one of C.P. Morgan’s Field
Supervisors’ Dan Metschke, “Will, you should be MORE WORRIED ABOUT RADON GAS INSTEAD OF THE RAW SEWAGE and/or FECAL MATTER SPILL”.  As of this writing, C.P. Morgan has not tested the house BY A CERTIFIED and QUALIFIED Radon testing facility.  C.P.

Morgan HAS NOT FIXED THE THREE CRACKS – (I don’t know if C.P. Morgan has a BASEMENT FOR A MODEL – BUT THREE CRACKS IN THE BASEMENT FLOOR CAN NOT BE CONSIDERED “SHOWROOM MODEL FINISH”.

 

C.P. Morgan and/or its’ subcontractors somehow ?!?!? dislodged my Pantry wash sink from the wall – I am still waiting on C.P. Morgan to repair it – I was told “Legs” to the sink would most likely fix the problem, (NOT SHOWROOM MODEL FINISH).

 

Because of the RAW SEWAGE/FECCAL Flood I was “TOLD” by the aforementioned “Dan Metschke” – C.P. Morgan would EXTEND my PLUMPING WARRENTY for an ENTIRE YEAR – after COMPLETION of problems in home.  I have seen NOTHING in writing – because – IN MY OPINION  – if C.P. Morgan’s Lips are moving – they are LYING – C.P. Morgan’s word is WORTHLESS – any dealings with C.P. Morgan MUST be Done it writing !!!

 

My front door has two window “sidelights”.  C.P. Morgan stills needs to calk and/or repair the screw holes in these windows which would almost certainly cause these window frames to be repainted white, (NOT SHOWROOM MODEL FINISH).

 

My “Upgraded” Kitchen Island has two top drawers and two lower cabinets – the top two drawers need to be replaced because they were damaged while the Kitchen was painted for the FIRST TIME !!!  (NOT

SHOWROOM MODEL FINISH).

In my Laundry room the “Hi – Lo Pipes” need to be secured – BOTH PIPES ARE JUST DANGLING FROM THE CEILING, (NOT SHOWROOM MODEL FINISH).

 

During remediation of the RAW SEWAGE/FECCAL MATTER FLOOD the siding of my attic, TO THE HOUSE,  (NOT DAMAGED) was “Punched Through” to make it EASIER to gain access into my attic – Unknown if C.P. Morgan’s Repair will withstand Indiana’s weather.  (AT THIS POINT – NOT SHOWROOM MODEL FINISH).  It should be noted, C.P. MORGAN choose to use old, dirty, and possibly moldy “Hardy Plank” material – than NEW – PLANKS – (NOT SHOWROOM MODEL FINISH)

 

During my ENTIRE first year of occupancy, my ROOF LEAKED – my drier vented INSIDE my attic because C.P. Morgan and/or its’ subcontractors FORGOT to put a drier vent through my ceiling of the attic.  C.P. Morgan had said both problems have been fixed – SAID - NOT WRITTEN AND NO MENTION OF ANY TYPE OF WARRENTY !!!

      

It was also during my first year of occupancy I ACTUALLY had to HIRE an ATTORNEY to address another issue with C.P. MORGAN.

 

With regards to this latest episode, CAUSED by and ADMITTED BY C.P. MORGAN that took place (AGAIN PLEASE GO TO: cpmorgancomplaints.com ) to see specific details.

I have been so sick that my DOCTOR using C.P. MORGAN’s own Air Quality report from MICROAIR told me to vacate the home on March 31, 2006.  It should be noted my throat – at the time of this writing is hurting – it could be just a regular cold coming on – however – it could be a result of the respiratory damage that occurred while I was allowed to stay in my home from January 30, 2006 through until my doctor ordered me out of the house in March 31, 2006.  If my throat continues to hurt – I will once again visit my doctor, in the very near future.

 

I have literally lived in my pick-up truck for over two months – I have had no use of a washer and drier since the incident occurred – (I am forced to wash my clothes at a laundry mat) – I have had to eat “fast food” which gets to be very expensive, from March 31, 2006 through August 11th, 2006 – I have been FORCED to pay for various EXPENSIVE air quality tests because C.P. MORGAN REFUSED TO PAY FOR SUCH TESTS AND LIED SAYING it was SAFE for me to occupy my home (my doctor felt otherwise) – I have lost personal property damaged by the RAW SEWAGE/FECCAL MATTER FLOOD – INCLUDING MUCH OF MY WINTER CLOTHING – I have had to pay for my MORTGAGE to the house when it was not even safe for me to live in the house – not to mention various utilities to the house - I have paid for hotel rooms – I have had numerous unexpected miscellaneous expenses – I have had numerous doctor and medication expenses – attorney fees and of course fuel expenses for my truck.  Due to these unexpected

aforementioned expenses I have not been able to pay my property taxes nor any of my unsecured credit cards.

 

It should be noted:  C.P. Morgan originally said they would RE-TEST the home AFTER THE REMEDIATION WAS COMPLETED (approximately 90 days).  Well, of course, C.P. Morgan - makes up the rules to the game and said it was “Safe” for me to go back into my home – with NO AIR QUALITY TEST – to – in fact – back up the claim my house was safe.  The only thing C.P. Morgan said is they are ONLY OBLIGATED to do the AIR QUALITY TEST IN 90 DAYS (therefore I would have to REMAIN in my PICKUP TRUCK for an additional 90 DAYS.  C.P. Morgan did however offer an alternative – If I would waive the 90 day RE-TEST to CONFIRM no more MOLD OR BACTERIA WAS IN MY HOME – THEY WOULD IMMEDIATELY TEST THE HOME – MY PERSONAL FEELING THIS IS CLEARLY EXTORTION BY THE BUILDER, C.P. MORGAN.  THIS HOME MUST BE COMPLETELY RETESTED TO ASSURE THERE IS NO MORE DANGEROUS AND POSSIBLE LIFE THREATENING MOLD(S) OR BACTERIA(S) WITHIN THIS HOME.

 

The “Bottom Line” is, after discussing my situation with a Bankruptcy attorney the most obvious answer to my outstanding debts (various credit cards, home mortgage, truck payment and property taxes of which  are due in November 2006)– (I was unable to pay the property taxes due in May of 2006) – was for me to file bankruptcy and just walk away from the house.

I did however talk to a debt consolidation company and was told that if I contacted my mortgage holder, You, (Bank of America) – they, (Bank of America) might consider some alternative financing for a period of time (THE LONGER, THE BETTER) – which of course I know this would most likely extend the length of my loan.  IF THIS IS POSSIBLE  - PLEASE ADVISE AS SOON AS POSSIBLE – if Bank of America can’t do anything – then I will probably have to file bankruptcy and walk-away from the home.  The debt consolidation company also said if I was in a position to “offer to settle” with the various outstanding credit cards – most would settle at a much lower balance than is currently reflected in the various credit reports.  The debt consolidation further related many of the DEROGATORY credit ratings could be “persuaded” to reflect either a NUETRAL or REMOVE the DEROGATORY all together.

 

It should be noted my credit score is probably the worst Bank of America has ever seen – however – the financial problems I have suffered through have been for the most part caused by actions and/or inactions of C.P. Morgan.

 

My two sources of income are from my POLICE PENSION - PERS @ 2001.00 a month (tax free) - and

Disability Social Security (100% Disabled) – 1359.00 a month (tax free).

 

My Home Mortgage is $1,119.95 a month – Never been late.

My Truck Payment is $350.00 a month – Never been late.

 

I am on “Budget Bill” Plan for the Gas Company at $150.00 a month.

 

I am also on “Budget Bill” Plan for the Electric Company at $136.00

 

My home insurance is $205.00 a month

 

IF – YOU - Bank of America - doesn’t do SOMETHING to help me out – I WILL BE FORCED TO WALK AWAY FROM THIS HOUSE – I have been PROTECTING YOUR VERY LARGE INTEREST IN THIS PROPERTY – WITH VERY LITTLE OUTSIDE HELP !!!  Even if I WANTED to SELL this property I personally doubt that I would even get the MORTGAGED amount, (A house very similar to mine, (but with ALL the upgrades) sat “dormant” for approximately 18 months – unknown exact selling price – but I know the asking price was $162,000 – I think my house is “Over Built” for the area – (Most houses in the Heritage Community are going for 90-150,000 + there are still over 300 lots that need to be sold – so it is very hard to sell a house to someone when that person can just build a brand new house on another lot – not to mention – who in their right mind would buy a home that has had RAW SEWAGE/FECCAL MATTER seep from the 2nd floor down through the 1st floor – it is absolutely disgusting, (the RAW SEWAGE/FECCAL MATTER FLOOD IS ON THE C.L.U.E. LIST OF INSURANCE COMPANIES

AND/OR THE REALTORS’ LISTINGS – IN OTHER WORDS – YOU MUST DISCLOSE THIS INCIDENT TO ANY AND ALL PROSPECTIVE BUYERS.

 

Currently I pay the following approximately:

 

“Indoor Air Management” $200.00 a month.

$150.00 a month for food.

 

$140.00 a month for diesel fuel.I pay approximately

 

$100.00 a month for various medical prescriptions.

 

$20.00 a month for Sewer.

 

$19.00 a month for Association Fees.

 

Dish Network approximately $60.00 a month.

 

Embark approximately $100.00 a month for phone / DSL.

 

Indiana Water approximately $40.00 a month for water.

 

Various Doctors 250.00 a month.

 

Property taxes  $200.00 (originally I was told by C.P. Morgan my property taxes would be 1% of purchased price), well, they are almost $400.00 a month.
